As Diamond Select Toys (DST) has moved along with production on the Back to the Future Delorean car, DST was made aware of an issue came up during the approval process. Universal had signed off on the final paint sample with a caveat that they were not responsible to get approval for the car that made up the base for the Delorean. Since this came out of nowhere, our licensing contact called their office and was given nothing hard to go on. DST went back to Universal, who wasn't in a position to clear the rights for the actual core car design. We did some research on our own and discovered that someone had in fact purchased all the relevant marks to the defunct DMC. We were able to contact them and discuss our situation. They were already aware of the car and claimed it looked JUST like a car off the showroom floor...in fact our authenticity might have counted against us. Their main concern was with the DMC logo's on the grill and wheels. In discussions with them they admitted that they were still working with Universal to find where the Delorean stopped and time machine began. In lieu of waiting for that to resolve itself, DST offered to remove the logos thereby removing any of the concrete claims they would have over our toy. We agreed that since the wheels and grill marks were very small, we would proceed without them rather than get tied up with something that would take longer to resolve this situation.
While DST set out to produce the most accurate Back to the Future Delorean car possible (and we think we nailed it, especially by the overall response from consumers, retailers and media), we just weren't able to go with our original markings without potentially ending up in a legal dispute which would have put the entire project in jeopardy.
